AN ACT TO AMEND THE LAWS OF DELAWARE RELATING TO THE BOND AND CAPITAL IMPROVEMENTS ACT OF THE STATE OF DELAWARE AND CERTAIN OF ITS AUTHORITIES FOR THE FISCAL YEAR ENDING JUNE 30, 2020.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend Chapter 86, Volume 82 of the Laws of Delaware by amending Section 2 by making deletions as shown by strike through and insertions as shown by underline as follows:

Section Authorization of Twenty-Year Bonds. The State hereby authorizes the issuance of bonds, to which the State shall pledge its full faith and credit, such bonds to be issued in such principal amount as necessary to provide proceeds to the State in the amount of $230,515,000 and in the amount of $46,861,070 $43,626,737 local share of school bonds. Bonds authorized to be used by this Section shall mature not later than 20 years from their date of issuance. The proceeds of such bonds, except for local share of school bonds, are hereby appropriated for a portion of the purposes set forth in Section 1 Addendum of this Act and summarized as follows:

Section 2. Amend Chapter 86, Volume 82 of the Laws of Delaware by amending Section 27 by making deletions as shown by strike through and insertions as shown by underline as follows:

Section 27. Community Reinvestment Fund. The Section 1 Addendum of this Act appropriates $6,701,117 to assist community organizations with capital infrastructure projects that will provide a benefit to the State. These funds shall be distributed for the following purposes (if specified), in the following amounts, to the following organizations:

Any organization receiving funds shall first provide to the Controller General and Director of the Office of Management and Budget, a copy of their most recent audit and a list of all other project contributors if the project is being matched with other funding. Any organization receiving funds shall also provide to the Controller General and the Director of the Office of Management and Budget, a full report, within sixty days of the completion of the project receiving funding from the Community Reinvestment Fund, detailing the work that was done and the final cost and providing an accounting of all funds that were used in the completion.

Section 3. Amend Chapter 86, Volume 82 of the Laws of Delaware by amending Section 28 by making deletions as shown by strike through and insertions as shown by underline as follows:

Section 28. Municipal Infrastructure Fund. The Section 1 Addendum of this Act appropriates $2,402,215 to assist municipal governments with capital infrastructure projects. These funds shall be distributed for the following purposes (if specified), in the following amounts, to the following municipalities:

Section 5. Amend Chapter 86, Volume 82 of the Laws of Delaware by amending Section 133 by making deletions as shown by strike through and insertions as shown by underline as follows:

Section 133. Behavior and Neuroscience Research Building Study. Section 1 Addendum of this Act makes appropriations to Delaware State University. Of this amount, $250,000 $100,000 shall be used for a Behavior and Neuroscience Research Building Feasibility Study.  It is the intent of the General Assembly that such funding will not commit the state to future construction expenditures. $150,000 shall be used for renovation of the community building located in Capital Park.

Section 6. Amend Chapter 86, Volume 82 of the Laws of Delaware by adding a new Section 164 by making insertions as shown by underline as follows:

Section 164. Department of Correction. The Section 1 Addendum of this Act appropriates $3,410,776 to the Department of Correction for Maintenance and Restoration. Notwithstanding any other statutory provisions to the contrary, the Department of Correction may use this appropriation for the purpose of proceeding with soundproofing the drug treatment space at Howard R. Young Correctional Institution; a design and location study for the Plummer Community Correction Center; and a study to convert the Central Violation of Probation Center into a department training center, Cognitive Community, or post-release re-entry center.

Section 7. Amend Chapter 86, Volume 82 of the Laws of Delaware by adding a new Section 165 by making insertions as shown by underline as follows:

Section 165. City of Wilmington Recreational Equipment. The Section 1 Addendum of this Act appropriates $12,100,000 to the Office of Management and Budget for the City of Wilmington Education Initiatives. Notwithstanding any other statutory provisions to the contrary, the funds shall be inclusive of recreational equipment at the City of Wilmington’s Kirkwood Park in partnership with the Dual Generation Center at Stubbs Elementary School.

Section 8. Amend Chapter 86, Volume 82 of the Laws of Delaware by adding a new Section 166 by making insertions as shown by underline as follows:

Section 166. Complete Count Commission. Notwithstanding any other provision or law to the contrary, the State, via the Complete Count Commission, may enter into contractual agreements with a non-profit with respect to the census count activities in Kent and Sussex County. Any use of such funds shall be limited to the census count activities in Kent and Sussex County.

Section 9. Amend Chapter 86, Volume 82 of the Laws of Delaware by adding a new Section 167 by making insertions as shown by underline as follows:

Section 167. Transfer of Vehicle Storage Facility. Chapter 376 of Volume 76 of the Laws of Delaware is repealed.

Section 10. Amend Chapter 86, Volume 82 of the Laws of Delaware by adding a new Section 168 by making insertions as shown by underline as follows:

Section 168. Paper Mill Road Land Transfer. Notwithstanding the provisions of 29 Del. C. c. 94, the Delaware National Guard shall transfer the parcel of land located at Paper Mill Road in Newark, DE comprised of approximately 3.33 acres known as New Castle County Tax Parcel #1800800003 to the Department of Natural Resources and Environmental Control.

Section 11. Amend Chapter 86, Volume 82 of the Laws of Delaware by adding a new Section 169 by making insertions as shown by underline as follows:

Section 169. Dover Air Force Base Land Transfer. Notwithstanding 29 Del. C. c. 94 or any other law to the contrary, the Office of Management and Budget is hereby authorized to transfer Kent County Tax Parcel 2-00-09600-01-1400-000 to the United States Government. 

Section 12. Amend Chapter 86, Volume 82 of the Laws of Delaware by adding a new Section 170 by making insertions as shown by underline as follows:

Section 170. Community Transportation Funds. Notwithstanding any provision of Title 29 to the contrary, the Delaware Department of Transportation is hereby authorized to use Community Transportation Funds for a one-time reimbursement to each of the following:

1. The Carlisle Fire Company, in the amount of $51,000 for a traffic control unit.

2. The Christiana Fire Company, in the amount of $90,000 for a cable relocation project.

3. The Breezewood Community, in the amount of $25,000 for noise abatement fencing.

4. The Frederica Fire Company, in the amount of $25,000 for a command vehicle.

5. The Office of Management and Budget, in an amount of up to $7,500 for a sign honoring Ethel Mae Cooper at the exterior of the Absalom Jones Community Center.

6. The Be Ready CDC, in an amount of up to $100,000 for lighting, mural, and safety projects.

7. The Woodbridge School District, in an amount of up to $60,000 for LED signs.

8. The Kenton Ruritan Club, in the amount of $38,000 for an LED sign.

9. The Harvest Years Senior Center, in an amount of up to $7,900 for a lighting and flagpole project on the POW Parkway.

10. The Town of Smyrna, in the amount of $55,000 for expansion of the Navy memorial monument at Lake Como Park to include a Marine Corp memorial.

11. The Laurel Public Library, in the amount of $40,000 for parking lot and landscape improvements.

Section 13. Amend Chapter 86, Volume 82 of the Laws of Delaware by adding a new Section 172 by making insertions as shown by underline as follows:

Section 172. Riverfront Development Corporation. Notwithstanding any other provision or law to the contrary, the Delaware Department of Transportation may enter into contractual agreements with the Riverfront Development Corporation (RDC) with respect to the use of Community Transportation Funds for transportation activities related to the redevelopment of the Brandywine and Christina riverfront areas.

Section 14. Amend Chapter 86, Volume 82 of the Laws of Delaware by adding a new Section 173 by making insertions as shown by underline as follows:

Section 173. South Market Street Redevelopment. The Delaware Department of Transportation is authorized to enter into agreements with the City of Wilmington and /or the Riverfront Development Corporation (RDC) with respect to the use of Transportation Trust Funds related to the redevelopment of South Market Street in accordance with the South Market Street Master Plan.  Funds shall be expended only with the approval of the Co-Chairs of the Bond Bill Committee.  Funds shall only be utilized for public transportation initiatives related to the redevelopment.

Section 15. Amend Chapter 86, Volume 82 of the Laws of Delaware by adding a new Section 174 by making insertions as shown by underline as follows:

Section 174. Charles W. Bush Early Education Center. The Brandywine School District is authorized to use up to $30,000 of its state share of Minor Capital Improvements funding for site planning activities relating to the Charles W. Bush Early Education Center.

Section 16. Amend Chapter 86, Volume 82 of the Laws of Delaware by adding a new Section 175 by making insertions as shown by underline as follows:

Section 175.  Town of Laurel. Notwithstanding any other provision or law to the contrary, the Director of the Office of Management and Budget, upon the concurrence of the Controller General, is authorized to transfer $50,000 from the Office of Management and Budget, Contingencies and One-Times to the Town of Laurel – Public Safety Buildings Roof Replacements and Renovations.

Section 17. Amend Chapter 86, Volume 82 of the Laws of Delaware by adding a new Section 176 by making insertions as shown by underline as follows:

Section 176.  Ministry of Caring. Section 1 Addendum of this Act makes appropriations to Delaware State Housing Authority. Of this amount, and upon concurrence from the Director of the Office of Management and Budget and the Controller General, $100,000 shall be allocated to the Ministry of Caring for renovations to the House of Joseph Residence.
