AN ACT TO AMEND SECTIONS 201(C), 201(D) AND 706(D) OF TITLE 26 OF THE DELAWARE CODE RELATING TO JURISDICTION AND POWERS OF THE PUBLIC SERVICE COMMISSION.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend § 201, Title 26 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§201 General jurisdiction and powers.

(c) Notwithstanding any other provision of law, in the exercise of supervision and regulation over public utilities that provide telecommunications services, the Commission:

(d)(8) The Commission, after notice and hearing, may prospectively revoke or reverse any forbearance of regulation granted hereunder where it finds that doing so is in the public interest. Where the Commission revokes or reverses a prior decision made under paragraph (c) (d)(1) of this section, the Commission shall determine that the current rates for the related products or services are just and reasonable or shall establish new rates that are just and reasonable.

Section 2. Amend § 706, Subchapter VII-A, Chapter 1, Title 26 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§ 706. Offering, classification and abandonment of service

(d) Basic services other than switched access may be abandoned pursuant to § 203A of this title. Notwithstanding the provisions of § 203A(c) (d) of this title, a service provider may abandon a competitive service at any time.
