AN ACT TO AMEND THE LAWS OF DELAWARE TO ALLOW THE BOYS AND GIRLS CLUB OF DELAWARE, INC. TO CONVEY THE RICHARD ALLEN SCHOOL PROPERTY TO THE RICHARD ALLEN COALITION INC.

WHEREAS, Pursuant to Section 142 of the FY 2012 Bond Bill [SB 130 of the 146th General Assembly], the Indian River School District conveyed the Richard Allen School property to the Boys and Girls Club of Delaware Inc.; and

WHEREAS, The transfer included a reversion to the Indian River School District should the property cease to be used by the Boys and Girls Club of Delaware Inc.; and

WHEREAS, All parties are in agreement that the best use of the Richard Allen School property can be made by the Richard Allen Coalition, Inc.

NOW, THEREFORE:

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Three-fourths of all members elected to each house thereof concurring therein):

Section 1. The reversion requirement in Section 142 of Vol 78, Chapter 76 of the Laws of Delaware and in the resulting deed [book 3960, page 218] is hereby waived for the purpose of allowing the Boys and Girls Club of Delaware Inc. to transfer the Richard Allen School property pursuant to Section 2 of this Act.

Section 2. (a) Notwithstanding the reversion requirement in Section 142 of Vol 78, Chapter 76 of the Laws of Delaware and in the resulting deed [book 3960, page 218], the Boys and Girls Club of Delaware, Inc. is hereby authorized and empowered to execute and deliver to the Richard Allen Coalition Inc. a good and sufficient deed to transfer and convey all that certain parcel of land and all structures thereon, known as the Richard Allen School located in Sussex County, Delaware (tax parcel 1-35 20-70). This conveyance shall be for consideration of $1.00 or, upon written agreement of the parties, the consideration shall include a portion of the monies (not to exceed $6,000) expended on the property by the Boys and Girls Club, and shall be “as is” in that the Richard Allen Coalition Inc. shall accept the building and land in their present condition as of the time of conveyance.

(b) The deed to the aforesaid property shall contain a provision whereby said property will revert to the Indian River School District in the event the property or any part thereof ceases to be used by the Richard Allen Coalition Inc.
