AN ACT TO AMEND TITLE 24 OF THE DELAWARE CODE RELATING TO ELECTRICIANS AND ELECTRICAL CONTRACTORS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend §1402, Title 24 of the Delaware Code by renumbering subsections (9) through (19) as subsections (10) through (20) respectively and inserting a new subsection (9) as follows:

"(9) ‘Journeyperson electrician’ shall mean a person who is qualified and skilled to perform electrical work and who has met the requirements of §1408 of this title to be licensed as a journeyperson electrician.".

Section 2. Amend §1402, Title 24 of the Delaware Code by renumbering subsections (1) through (20) as subsections (2) through (21) and inserting a new subsection (1) as follows:

"(1) ‘Apprentice electrician’ shall mean a person who is licensed by the Board and whose principal occupation is the learning and assisting in the performance of electrical services.".

Section 3. Amend §1406(a)(4), Title 24 of the Delaware Code by deleting the language "and master electrician special," as it appears after the word "electrician" and before the words "in this" and substituting in lieu thereof the words "master electrician special, journeyperson electrician and apprentice electrician,".

Section 4. Amend §1406(b), Title 24 of the Delaware Code by inserting after the words "receiving a" and before the word "license" the language "master electrician, master electrician special, limited electrician or limited electrician special".

Section 5. Amend §1408(a), Title 24 of the Delaware Code by renumbering paragraphs (5) through (9) as paragraphs (7) through (11) and inserting new paragraphs (5) and (6) as follows:

"(5) For licensure as a journeyperson electrician shall:

a. Be at least 20 years of age.

b. Have successfully completed an apprenticeship program approved by the Board.

c. Have over eight thousand hours of full-time experience performing electrical work under the supervision of a licensed master electrician, master electrician special, limited electrician, or limited electrician special.

d. Any person who meets the requirement of subparagraph c. of this paragraph as of June 30, 2012 may have the requirements of subparagraph b. of this paragraph and the examination requirement of subsection (a)(6) of this section waived by the Board.

(6) For licensure as an apprentice electrician shall:

a. Be at least 18 years of age unless enrolled in a Board approved vocational program at a vocational school.

b. Be enrolled in or have successfully completed an apprentice program approved by the Board."

Section 6. Amend §1408(a)(5), Title 24 of the Delaware Code by inserting after the language "section," and before the word "shall" the language "a person applying for licensure as a master electrician, master electrician special, limited electrician, and limited electrician special".

Section 7. Amend §1419(a), Title 24 of the Delaware Code by deleting paragraphs (1) and (2) in their entirety and renumbering paragraphs (3) through (7) as paragraphs (1) through (5) respectively.

Section 8. Amend §1422, Title 24 of the Delaware Code by renumbering the existing §1422 as §1423 and inserting a new §1422 as follows:

"§1422 Apprentice Electricians.

(a) An apprentice electrician must work under the direct onsite supervision of a licensed master electrician, master electrician special, limited electrician, limited electrician special or journeyperson electrician.

(b) A licensed electrician supervising an apprentice electrician pursuant to subsection (a) shall be responsible for the activities of the apprentice electrician performing work in the State.".

Section 9. This Act shall take effect on June 30, 2012.
