AN ACT TO AMEND CHAPTER 65, VOLUME 295, LAWS OF DELAWARE, AN ACT TO REINCORPORATE THE TOWN OF BETHANY BEACH REGARDING THE HOLDING OF THE TOWN COUNCIL'S ORGANIZATIONAL MEETING TO BE CONSISTENT WITH THE PROVISIONS OF 15 DEL.C. CHAPTER 75 ("MUNICIPAL ELECTIONS").

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):

WHEREAS, Section 6.1 ("Organizational Meeting") the Charter of the Town of Bethany Beach, contained in Chapter 65, Volume 295, Laws of Delaware currently provides that the Town Council shall hold an organizational meeting "as soon as practicable, not exceeding twenty hour (24) hours, following the determination of the election results"; and

WHEREAS, 15 Del.C., § 7558 provides that no person certified as being elected shall take office before the seventh day following the election; and

WHEREAS, the Town Council has requested an amendment to the Town's municipal charter so as to be consistent with the State statute;

NOW THEREFORE:

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):

Section 1. Amend Section 6.1, Chapter 65, Volume 295, Laws of Delaware by striking the phrase:

"not exceeding twenty four (24) hours, following the determination of the election results by the Election Board" and substituting in lieu thereof the following:

"upon the expiration of seven days following the election".
