AN ACT TO AMEND CHAPTER 23, TITLE 13 OF THE DELAWARE CODE RELATING TO GUARDIANSHIP OF A CHILD.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :
Section 1. Amend §2325(a)-(d), Chapter 23, Title 13 of the Delaware Code by deleting the word “hearing” wherever it occurs in the section and replace thereto with the word “proceeding”.
Section 2. Further amend §2325, Title 13 of the Delaware Code by deleting the current subsections “(c)” and “(d)” and replacing thereto as a new subsection “(c)” the following:
“(c) If the Court shall find that personal service within the State cannot be accomplished upon the parent or parents, person or persons, or organization holding parental rights, the Petitioner shall cause notice to be published in a newspaper of general circulation in the county where the Respondent is most likely to be residing.”.
Section 3. Further amend §2325, Title 13 of the Delaware Code by redesignating the existing subsections “(e)” and “(f)” as “(d)” and “(e)”.
