HOUSE AMENDMENT NO. 1
AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO ELECTRIC POWERED BICYCLES.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend § 101(2), title 21 of the Delaware Code, by striking the words “shall mean” and by substituting in lieu thereof the words “shall include”.
Section 2. Amend § 101(2), title 21 of the Delaware Code, by inserting immediately after the period (“.”) as it appears at the end thereof the following sentence:
“The term ‘bicycle’ also includes a two- or three-wheeled vehicle with fully operable pedals and an electric motor of less than 750 watts (1h.p.), whose maximum speed on a paved level surface, when powered solely by such motor while ridden by an operator who weighs 170 pounds, is less than 20 m.p.h.”
