AN ACT TO AMEND TITLE 18 OF THE DELAWARE CODE RELATING TO THE LICENSURE OF AUTOMOBILE CLUBS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :

Section 1. Amend Title 18, Chapter 9, Subchapter I of the Delaware Code by adding a new § 908A thereto as follows:

“§ 908A. ‘Automobile Club’ defined.

Automobile Club means a legal entity which, in consideration of dues, assessments or periodic payments of money, promises its members or subscribers to assist them in matters relating to motor travel or the operation, use or maintenance of a motor vehicle, by supplying services which may include but are not limited to towing service, emergency road service, indemnification service, guaranteed arrest bond certificate service, discount service, financial service, theft service, map service or touring service.”

Section 2. Amend Title 18, § 1707(b) of the Delaware Code by renumbering subsection (4) as subsection (5) and adding a new subsection (4) as follows:

“(4) Automobile Club where its activities are limited to those specified in § 908A of this Title.”

Section 3. Amend Title 18, § 1709 of the Delaware Code by adding a new subsection (e) thereto as follows:

“(e) Every applicant for a license as an automobile club licensee.”

Section 4. Amend Title 18, § 506 of the Delaware Code by adding a new subsection (7) thereto as follows:

“(7) An automobile club so long as its activities are restricted to those defined in § 1707(b)(4) of this Title.”
