AN ACT TO AUTHORIZE THE POSSESSION OF CERTAIN HISTORICALLY AUTHENTIC WEAPONS FOR A LIVING HISTORY RE-ENACTMENT TO BE HELD MAY 5, 2004 THROUGH MAY 11, 2004.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :

WHEREAS, the Fort DuPont Society, Inc., and others, have proposed an educational and cultural event known as the “American Soldier Timeline,” the objective of which is to accurately depict and portray American military conflicts though history, beginning with the French and Indian War and continuing through Operation Desert Storm and beyond; and

WHEREAS, the American Soldier Timeline is scheduled to take place May 5 through May 11, 2004, at Fort DuPont State Park, near Delaware City, Delaware; and

WHEREAS, the sponsors of the American Soldier Timeline intend to provide for the use, possession and display of certain firearms as part of the event, and the possession of some such firearms could be deemed to conflict with the provisions of certain provisions of the Delaware Code; and

WHEREAS, the General Assembly deems it advisable that the use, possession, transportation and display of certain firearms as part of the American Soldier Timeline to be worthwhile in order to accurately depict events to be portrayed by re-enactors as part of the American Soldier Timeline programs;

NOW, THEREFORE, BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE AS FOLLOWS:

Section 1: Anything in Section 1444 of Title 11, Delaware Code, to the contrary notwithstanding, for purposes of a living history reenactment to be conducted in and around Fort DuPont State Park during May 5, 2004 through May 11, 2004, persons associated with and/or recognized by the Fort DuPont Society Inc., shall be permitted to use, possess, transport and display automatic weapons, where such weapons have been duly registered under the National Firearms Act of 1968 (26 U.S.C. § 5801 et seq.).

Section 2. Nothing in this Act shall authorize the use of live ammunition in connection with the American Soldier Timeline and/or other events sponsored by the Fort DuPont Society, Inc.
