AN ACT TO AMEND CHAPTER 2, VOLUME 73, LAWS OF DELAWARE, AS AMENDED, BEING THE CHARTER OF THE TOWN OF SELBYVILLE TO PROVIDE FOR ADMINISTRATIVE PENALTIES FOR VIOLATIONS OF CIVIL ORDINANCES.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):
Section 1. Amend Section 4.2.30, Chapter 2, Volume 73, Laws of Delaware, as amended, by striking the period at the end thereof and adding the following:
"; to provide for penalties for violations of civil ordinances, not exceeding One Thousand Dollars ($1,000.00) per violation for each day of violation, as well as the Town's costs and expenses including reasonable attorney's fees, which penalties may be imposed and collected by the Town administratively or in a court of competent jurisdiction, and to provide that such fine or penalty may be applied to each and every violation for each and every day of violation. However, before such penalty may be imposed administratively, there shall be notice and an opportunity to be heard afforded the alleged violator. Such procedures shall be adopted by ordinance by the Town Council.”
