AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO PENSIONS AND BENEFITS FOR RETIRED STATE EMPLOYEES.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :
WHEREAS, the likelihood that Delawareans will be called into national service as a result of the September 11th terrorist attacks has created potential vacancies in important state government positions; and
WHEREAS many vacant State positions can best be filled by retired State employees, who will not need to be retrained for these jobs; and
WHEREAS the State wishes to remove any financial barriers to retired State employees assisting the State during the military action arising from the events of September 11th;
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend §5303(a)(1)(c), Chapter 53, Title 29 of the Delaware Code by striking said sub-paragraph in its entirety and substituting in lieu thereof a new subsection "(c)" to read as follows:
"c. A temporary, casual, seasonal or substitute employee as defined by the Board of Pension Trustees."
Section 2. Amend §5502(a)(3), Chapter 55, Title 29 of the Delaware Code by striking said paragraph in its entirety and substituting in lieu thereof a new subsection "3" to read as follows:
"(3) A temporary, casual, seasonal or substitute employee as defined by the Board of Pension Trustees."
