AN ACT AUTHORIZING AND DIRECTING THE BOARD OF NURSING TO WAIVE FOR SHIRLEY M. SANDERS THE REQUIREMENT THAT SHE BE A GRADUATE OF AND HOLD A CERTIFICATE FROM A STATE BOARD OF NURSING APPROVED PRACTICAL NURSING EDUCATION PROGRAM.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :

WHEREAS, Shirley M. Sanders of Millsboro, Delaware was first licensed as a practical nurse in the Commonwealth of Pennsylvania by the Pennsylvania Board of Nursing on February 21, 1967 by waiver of education and examination requirements; and

WHEREAS, Shirley M. Sanders, as a practical nurse licensed by waiver was permitted to sit for the practical nursing licensing examination in the Commonwealth of Pennsylvania which she passed and was thereafter licensed as a practical nurse by examination on December 11, 1981 by the Pennsylvania Board of Nursing where she is currently licensed as practical nurse (PN-078911-L); and

WHEREAS, The Delaware Nurse Practice Act [24 Del. C. ch. 19] requires, among other things, that to be licensed as a practical nurse an applicant must be a graduate of and hold a certificate from a State Board of Nursing approved practical nursing education program; and

WHEREAS, Shirley M. Sanders, who has relocated to Delaware to care for her invalid husband and who has an opportunity for employment with the Lewis Convalescent Center as a practical nurse, is not a graduate of a State Board of Nursing approved practical nursing education program and therefore does not qualify for licensure as a practical nurse in Delaware.

NOW THEREFORE:

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. The Board of Nursing is hereby authorized and directed to waive the requirement that Shirley M. Sanders be a graduate of and hold a certificate from a State Board of Nursing approved practical nursing education program as a condition for her licensure as a practical nurse in the state of Delaware.
