AN ACT TO AMEND TITLE 14 OF THE DELAWARE CODE RELATING TO THE SALE OF TIMBER AND THE DISPOSITION OF THE PROCEEDS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend §1057 of Title 14 of the Delaware Code by adding a new

subsection (f) to read as follows:

"(0 Notwithstanding any provisions of subsections (a), (b), (c), (d), or (e) of this

section, a school district may sell timber located on the real property of the school upon an affirmative vote of a majority of the members of the Board. Sixty percent (60%) of the net proceeds (after the expenses relating to the sale and any replanting of trees determined appropriate by the Board) from the sale shall be assigned to the school district to be used in conformance with subparagraphs b. and c. of paragraph 15 of subsection (a) of this section. The balance of the proceeds may be utilized by the Board as part of their general fund."
