SENATE AMENDMENT NO. 1
AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO FAMILY PRESERVATION SERVICES.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend §9003(3), Title 29 of the Delaware Code by designating the
existing language thereof as subparagraph "a" and by adding the following:
"b. The Division of Family Services will provide family preservation services to
those families whose children are at imminent risk of out-of-home placement when it has determined that out-of-home placement can be avoided; provided, however, that nothing herein will prevent the Division from removing a child from his or her home when it has determined that the child's safety and well-being may be jeopardized by remaining in the family home."
