AN ACT TO AMEND CHAPTER 101, TITLE 29, DELAWARE CODE RELATING TO THE DELAWARE ADMINISTRATIVE COMMISSION.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend Section 10153, Chapter 101, Title 29 Delaware Code by striking the text thereof and substituting in lieu thereof the following:

"Each agency shall file on the last work day of each month, with the Commission, in a format prescribed by the Commission, the full text of all Its rules and regulations, together with such additional information as may be necessary for the purpose of listing in accordance with §10154 of this title, which have been promulgated within that calendar month."

Section 2. Amend Section 10154, Chapter 101, Title 29, Delaware Code by striking subsection (b) thereof and substituting in lieu thereof the following:

"(b) The Commission shall publish, no later than the fifteenth day of each month, all rules and regulations promulgated within the previous month by each state agency, indexed by agency and subject matter. The Commission shall make each such publication available for public inspection and may charge a fee to any person requesting a copy or copies thereof. The fees collected shall be sufficient to defray all costs of publication and shall be deposited in a special fund to be used to produce the publication. Any balance in the special fund in excess of $10,000 at the end of any fiscal year shall revert to the General Fund of the State of Delaware. In addition, copies shall be provided to the Prothonotary of each county, all members of the General Assembly, the law library of each county, the Legislative Council law library and the Director of Libraries. Any additions and corrections shall likewise be made available as soon as practicable."

Section 3. This Act shall take effect December 16, 1991 so that

publication of the newly promulgated rules and regulations will commence in January of 1992 with the rules and regulations promulgated by state agencies in December of 1991.
