AN ACT TO AMEND TITLE 26 OF THE DELAWARE CODE RELATING TO THE GENERAL JURISDICTION AND POWERS OF THE PUBLIC SERVICE COMMISSION.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend Section 201, Subchapter II, Chapter 1, Title 26, Delaware
Code by adding thereto a new subsection to read as follows:
"(c) In the exercise of exclusive original supervision and regulation over public utilities, the Commission may, where it determines after notice and hearing that the public interest will be better served by the competitive provision of one or more public utility services, forbear from its normal supervision and regulation over such service or services and over some or all of the providers thereof to the extent the Commission deems necessary to promote and sustain adequate service at just and reasonable rates through the competitive provision of such services. The Commission may also revoke or reverse such forbearance where deemed necessary or appropriate in the public interest."
