AN ACT TO AMEND CHAPTER 41, TITLE 14 OF THE DELAWARE CODE RELATING TO CIVIL AND CRIMINAL LIABILITY OF SCHOOL EMPLOYEES OR SUPERINTENDENTS FOR PROVIDING INFORMATION TO CERTAIN AUTHORITIES CONCERNING STUDENT VIOLENCE AND STUDENT POSSESSION OF WEAPONS AND UNLAWFUL DRUGS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend subsection (d), Section 4112, Chapter 41, Title 14, Delaware Code by striking said subsection in its entirety and substituting in lieu thereof a new subsection to read as follows:

"(d) Immunity from Civil liability: review of criminal _complaint A school

employee, superintendent, or his designee who in good faith provides information to police and/or the State Department of Public Instruction under subsection (b) or (c) of this Section shall not be held civilly liable for providing such information. Prior to lodging any criminal charges against a school employee, superintendent or his designee who provides information to police and/or the State department of Public Instruction under subsection (b) or (c) of this Section the Attorney General's Office shall be consulted to determine the appropriateness of the charges."
