AN ACT TO AMEND CHAPTER 6, TITLE 14, DELAWARE CODE, RELATING TO ACCEPTANCE OF NON RESIDENT STUDENTS IN DELAWARE PUBLIC SCHOOLS AND TUITION FOR SUCH OUT-OF-STATE STUDENTS.

Be it enacted by the General Assembly of the State of Delaware:

Section I. Amend Chapter 6, Title 14, Delaware Code by adding thereto a new section, designated as §606, which new section shall read as follows:

"§606. Out-of-state students.

A handicapped pupil who is a resident of a state or country other than Delaware or the United States of America may be accepted, at the discretion of the receiving district, to attend a Delaware special school under the following restrictions:

(1) Handicapped children, only, as defined in §310I, Title 14, or for whom units are specified in §1703, Title 14, may be accepted for admission to a special school for handicapped children after the receipt of certification from the State Superintendent of Public Instruction that provisions have been made for all eligible state students within the region served by the special school.

(2) Full tuition costs as determined annually by the State Superintendent of Public Instruction shall be paid in advance by semester by the out-of-state or out-of-country

school district, state or national agency, or parent. The tuition cost shall reflect all state, local district and federal expenditures for the education of handicapped students attending the special school, excluding pupil transportation costs which shall not be the responsibility of the receiving Delaware school district or the State of Delaware. State costs shall be reimbursed to the General Fund of the State of Delaware and local district costs shall be retained by the receiving district."
