AN ACT TO CREATE THE BETHANY BEACH SANITARY SEWER DISTRICT, THE SOUTH BETHANY SANITARY SEWER DISTRICT, THE DEWEY BEACH WATER DISTRICT, AND THE DEWEY BEACH SANITARY SEWER DISTRICT AND TO AUTHORIZE THE ISSUANCE OF BONDS PURSUANT TO AND FOR THE PURPOSES SET FORTH IN TITLE 9, CHAPTER 65 OF THE DELAWARE CODE, INCLUDING TO REFUND OBLIGATIONS OF SUSSEX COUNTY ISSUED TO FINANCE IMPROVEMENTS IN SUCH DISTRICTS.

WHEREAS, Sussex County has created the Bethany Beach Sanitary Sewer District, the South Bethany Sanitary Sewer District and the Dewey Beach Sanitary Sewer District pursuant to Title 9, Chapter 65, Delaware Code; and

WHEREAS, Sussex County has issued obligations to finance the cost of improvements in such districts and now intends to issue bonds to finance additional improvements in such districts and to refund such obligations; and

WHEREAS, it is not apparent that sufficient evidence of the proper creation of such districts is available to form an opinion satisfactory to prospective purchasers of bonds issued to finance improvements within such districts that such districts have been properly created;

NOW THEREFORE:

Be it enacted by the General Assembly of the State Delaware:

Section 1. The Bethany Beach Sanitary Sewer District is hereby created. The boundaries of the District are as follows: All those lands lying within the corporate limits of the Town of Bethany Beach.

Section 2. The South Bethany Sanitary Sewer District is hereby created. The boundaries of the District are as follows: York Beach, Bay View, South Bethany, Middlesex Beach and all other lands between the aforementioned and the southerly limits of the Town of Bethany Beach between the Assawoman Canal and the Atlantic Ocean.

Section 3. The Dewey Beach Water District is hereby created. The boundaries of the District are as follows: All of those lands North of the "State Lands", bounded on the East by the Atlantic Ocean; on the North by the southern boundary of the corporate limits of the City of Rehoboth Beach; on the West by the Lewes-Rehoboth Canal and Rehoboth Bay; on the South by the "State Lands".

Section 4. The Dewey Beach Sanitary Sewer District is hereby created. The boundaries of the District are as follows: All of those lands North of the "State Lands", bounded on the East by the Atlantic Ocean; on the North by the southern boundary of the corporate limits of the City of Rehoboth Beach; on the West by the Lewes-Rehoboth Canal and Rehoboth Bay; on the South by the "State Lands".

Section 5. General obligation bonds are hereby authorized to be issued pursuant to and for the purposes set forth in Title 9, Chapter 65, Delaware Code, including to refund obligations issued by Sussex County to finance the cost of sewer and water improvements in said Districts.
