AN ACT RELATING TO A PENSION FOR GEORGE ROSSITER, A FORMER EMPLOYEE OF THE DE LA WARR SCHOOL DISTRICT.

WHEREAS, George Rossiter, of 230 Spring Valley, Frederica, was employed by the De La Warr School District for eight years and seven months, from December 1959, to August 1969; and

WHEREAS, at the time of Mr Rossiter's retirement on August 31, 1969, the law applicable to retirement permitted payment of a pension only to those who had 15 years of service at age 60; and

WHEREAS, the pension laws were changed effective June 1, 1970, so that if Mr. Rossiter had remained in service for another 10 months he would have been eligible for retirement at 65 with as little as five years of service; and

WHEREAS, for Mr. Rossiter to obtain a pension it is necessary that the General Assembly enact legislation directing the Bbard of Trustees of the State Employees' Retirement Fund to accept his application and determine that he is eligible for a pension.

NOW THEREFORE:

Be it enacted by the General Assembly of the State of Delaware:

Section 1. The Board of Trustees of the State Employees Retirement Fund is hereby directed to accept the application of George Rossiter for a service pension, and the Board of Trustees is further directed to determine that George Rossiter is eligible for a service pension, any provisions of the State Employees Pension Plan to the contrary notwithstanding.
