CHAPTER 295 - LEWES MEMORIAL COMMISSION

AN ACT TO AMEND CHAPTER 178 OF THE REVISED CODE OF DELAWARE, 1935, ENTITLED "COMMEMORATION OF THE LANDING OF THE FIRST SETTLERS OF THE STATE OF DELAWARE AT LEWES", WITH REFERENCE TO THE NAME OF THE COMMISSION CREATED BY SAID ACT, ITS MEMBERS, POWERS, AND DUTIES.

Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

Section 1. That Chapter 178 of the Revised Code of Delaware, 1935, be amended by striking out and repealing 6224. Sec. 1. thereof and by inserting and enacting in lieu thereof a new section to be known and styled 6224. Sec, 1.

6224. Sec. 1. The name of the Lewes Tercentenary Commission is hereby changed to Lewes Memorial Commission to consist of ten members who shall be residents of the State of Delaware and be appointed by the Governor. The seven members of Lewes Tercentenary Commission shall be members of Lewes Memorial Commission and continue as such members during the terms for which they were originally appointed. As soon as possible after the approval of this Act the Governor is authorized and requested to appoint three additional members of Lewes Memorial Commission for terms of seven years. Upon the appointment of the three additional members, the full commission shall meet and organize by the election of a chairman and a secretary and such other officers as may be deemed necessary.

Any vacancy in said Lewes Memorial Commission caused by expiration of term shall be filled by appointment of the Governor for the term of seven years. Vacancy existing on said Commission for any other cause shall be filled by appointment of the Governor for the residue of the term.

Section 2. That Chapter 178 of the Revised Code of Delaware, 1935, be and the same is hereby further amended by striking out and repealing 6225. Sec. 2. thereof and by inserting and enacting in lieu thereof a new section to be known and styled as 6225. Sec. 2., as follows:

6225. Sec. 2. The Commission so constituted is hereby authorized to have the full and complete care and supervision of the DeVries Monument, at Lewes, Delaware, the Zwaanendael Museum (erected in accordance with Chapter 178 of the Revised Code of Delaware, 1935), at Lewes, Delaware, and such other buildings, memorials or parks as shall come under the jurisdiction of the Commission. This Commission shall keep the property in its custody in proper condition at all times; and shall cause reasonable and necessary repairs to be made.

Section 3. That Chapter 178 of the Revised Code of Delaware, 1935, be and the same is hereby further amended by striking out and repealing 6226. Sec. 3. thereof and by inserting and enacting in lieu thereof a new section 6226. Sec. 3. as follows:

6226. Sec. 3. The Lewes Memorial Commission is hereby authorized to have constructed in the Town of Lewes a memorial to seamen which may be either a building, monument, park, or other appropriate construction, and which shall be given an official name by the Commission, when it shall have been completed.

The said Commission is authorized to prepare plans, specifications and drawings and to employ such needed assistants as may be necessary including an architect or architects; to advertise for bids; to require bidders to give proper bonds; to reject any and all bids for reasons deemed sufficient to said Commission; to enter into agreements and contracts necessary to carry on the work of constructing the proposed memorial including contracts for services, labor and materials needful or proper for the purposes aforesaid or any of them; to call upon any other Department or Agency of the State Government for advice and assistance in planning the proposed memorial and to further the work of construction when necessary plans have been completed.

Section 4. That Chapter 178 of the Revised Code of Delaware, 1935, be and the same is hereby further amended by striking out and repealing 6227. Sec. 4. thereof and by inserting and enacting in lieu thereof a new 6227. Sec. 4., as follows:

Any funds received from other than State appropriations may be paid to the State Treasurer, who shall keep the same in a separate fund or account, and such funds shall be used only for the purpose of carrying out the provisions of this Act.

Any money appropriated for the use of Lewes Tercentenary Commission under any law of the State of Delaware now or hereafter enacted, and not expended at the time of the approval of this Act, may be used by the Lewes Memorial Commission to carry out the purposes of this Act including care, custody and repair of buildings and memorials already erected.

Any payment of such funds shall be made by the State Treasurer upon warrants drawn by the State Auditor upon presentation to him of specifically itemized vouchers approved by the chairman and secretary of the said Commission.

All acts or parts of acts inconsistent with this act are hereby repealed to the extent of such inconsistency only.
