CHAPTER 276 - STATE HIGHWAY DEPARTMENT AUTHORIZING DEPARTMENT TO CLASSIFY TRAFFIC OFFICERS

AN ACT TO AMEND ARTICLE 4 OF CHAPTER 166 OF THE REVISED CODE OF DELAWARE, 1935, RELATING TO TRAFFIC OFFICERS BY AUTHORIZING THE STATE HIGHWAY DEPARTMENT TO CLASSIFY SUCH OFFICERS AND REGULATE THE SALARIES THEREOF.

Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

Section 1. That Article 4 of Chapter 166 of the Revised Code of Delaware, 1935, as amended, be and the same is hereby further amended by striking out and repealing 5747. Sec. 28 of said Article and inserting in lieu thereof the following:

5747. Sec. 28. Police Officers; Duties; Classifications; Salaries; Police Powers:--The Department is authorized to appoint police officers whose primary duty shall be to compel the enforcement of all laws relating to the weight, speed and operation of vehicles on the public highways of the State. They shall be officially known and referred to as "State Police." The Department is further authorized to classify such State Police according to such rank as the Department shall determine, and according to the duties assigned to them from time to time by the Department.

Each of said State Police shall receive such salary, payable monthly, as the Department shall determine, which salary shall be based upon the rank and duties to be performed, provided, nevertheless, that no officer of the State Police, after having served two years as such, shall receive less than One Hundred Seventy-five Dollars ($175.00) per month.

State Police shall have police powers similar to those of sheriffs, constables and other police officers, and shall be conservators of the peace throughout the State, and they are hereby authorized, empowered and directed to suppress all acts of violence, and to enforce all laws relating to the safety of persons and property.
