CHAPTER 124 - LEVY COURTS--NEW CASTLE, KENT AND SUSSEX COUNTIES PAYMENTS TO COMMISSION FOR AID TO DEPENDENT CHILDREN

AN ACT TO AMEND CHAPTER 39 OF THE REVISED CODE OF DELAWARE, 1935, AS AMENDED, WITH RESPECT TO PAYMENTS BY THE LEVY COURTS OF NEW CASTLE, KENT AND SUSSEX COUNTIES, TO THE COMMISSION FOR AID TO DEPENDENT CHILDREN, TO BE USED BY SAID COMMISSION IN CARRYING OUT THE PURPOSES OF CHAPTER 39, REVISED CODE OF DELAWARE, 1935, AND THE ACTS AMENDATORY THERETO.

Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

Section 1. That Chapter 39 of the Revised Code of Delaware, 1935, as amended, be and the same is hereby further amended by repealing all of 1110. Section 7, and inserting in lieu thereof a new section to be known as 1110. Section 7, as follows:

1110. Section 7. Payments, How Made; Duty of Receiver of Taxes and County Treasurer; Administration Expenses; Duty of State Treasurer; Limitations:--The amount paid to a beneficiary hereunder shall be on a warrant drawn by the Commission or authorized agent thereof, on the Receiver of Taxes and County Treasurer of the County in which such beneficiary resides. The Levy Court of New Castle County is hereby authorized and directed to appropriate annually the sum of Thirty Thousand Dollars, ($30,000.00); the Levy Court of Kent County is hereby authorized and directed to appropriate annually the sum of Eleven Thousand Dollars, ($11,000.00); and the Levy Court of Sussex County is hereby authorized and directed to appropriate annually the sum of Fourteen Thousand Dollars, ($14,000.00), to be used by said Commission in carrying out the purposes of this Act. The Levy Courts of New Castle, Kent or Sussex Counties may appropriate additional sums of money for use in its County, provided, however, that for any additional sums of money so appropriated by the Levy Court of New Castle, Kent or Sussex Counties, the State of Delaware contributes a like amount for use in the said County, out of any moneys in the State Treasury, not otherwise appropriated. And the said Receiver of Taxes and County Treasurer of the County in which the beneficiary resides, is hereby authorized and directed to pay the said warrants, on the approval of the Comptroller of said County, out of the moneys appropriated by the respective Levy Courts for this purpose.

The travelling and administrative expenses of the Commission shall be paid on warrants drawn by the Commission, or authorized agent thereof, on the State Treasurer, and the State Treasurer is authorized and directed to pay said warrants on the approval of the State Auditor, from any money he may have belonging to the State not otherwise appropriated.

Section 2. All Acts or parts of Acts inconsistent herewith are hereby repealed, insofar as the inconsistency may appear only.

Section 3. This Act shall be effective as of July 1, 1945.
