CHAPTER 25 - APPROPRIATION - EMERGENCY APPROPRIATION FOR SCHOOL REPAIRS AND ADDITIONAL FUEL

AN ACT TO AMEND SECTION 4 OF CHAPTER 57 OF VOLUME 44, LAWS OF DELAWARE, 1943, RELATING TO "THE STATE EMERGENCY FUND" BY MAKING AN ADDITIONAL APPROPRIATION FOR EXTRAORDINARY SCHOOL REPAIRS AND BY MAKING AN APPROPRIATION FOR ADDITIONAL FUEL FOR THE REMAINDER OF THE FISCAL YEAR ENDING JUNE 30, 1945.

Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

Section 1. That Section 4 of Chapter 57 of Volume 44, Laws of Delaware, 1943, be and the same is hereby amended by adding two new paragraphs to be known as paragraphs (1) and (m) as follows:

(1) To provide for additional repairs of an extraordinary nature required for the period ending June 30, 1945, the State Board of Education, if the building or equipment is located in a school district outside of the City of Wilmington or the Board of Public Education in Wilmington, if the building or equipment is located in the consolidated school district in the City of Wilmington, may, upon submission of satisfactory proof of emergency, be authorized to spend all or any part of an additional amount not to exceed Ten Thousand Dollars ($10,000.00) during the remainder of the fiscal year ending June 30, 1945.

(m) To provide for the purchase of additional fuel required for the period ending June 30, 1945, the State Board of Education if the appropriation for fuel for the current fiscal year of any school district outside the City of Wilmington is exhausted or the Board of Public Education in Wilmington if the appropriation for fuel for the current fiscal year is exhausted for the consolidated school district in the City of Wilmington, may, upon submission of satisfactory proof of emergency, be authorized to expend all or any part of an amount not to exceed Ten Thousand Dollars ($10,000.00) during the remainder, of the fiscal year ending June 30, 1945.

Section 2. This Act shall be taken and deemed to be a deficiency appropriation act and the sums hereby appropriated shall be paid out of the General Fund of the State Treasury not otherwise appropriated.

Section 3. All acts or parts of acts inconsistent with the provisions of this Act are hereby repealed to the extent of such inconsistency only.
