AN ACT TO AMEND THE CHARTER OF THE CITY OF DOVER TO PROVIDE FOR CERTAIN MATTERS RELATING TO LEVY AND COLLECTION OF SPECIAL AD VALOREM TAXES, SPECIAL TAXES, AND AD VALOREM TAXES IN CONNECTION WITH A MUNICIPAL TAX INCREMENT FINANCING AND A MUNICIPAL DEVELOPMENT DISTRICTS FINANCING.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):

Section 1. Amend Section 48, Article IV of the Charter of the City of Dover by making deletions as shown by strike through and insertions as shown by underline at the end of existing Section 48 as follows:

Section 48. Maximum budget.

The amounts to be levied and collected by the council shall include all special ad valorem taxes, special taxes, and ad valorem taxes levied in connection with or pursuant to Chapter 17 or Chapter 18 of Title 22 of the Delaware Code.

Section 2. Amend Section 49, Article IV of the Charter of the City of Dover by making deletions as shown by strike through and insertions as shown by underline at the end of Section 49 as follows:

Section 49. Payment and collection of taxes; errors and delinquents in assessments.

The provisions of this Section 49 shall apply to all special ad valorem taxes, special taxes, and ad valorem taxes levied by the council in connection with or pursuant to Chapter 17 or Chapter 18 of Title 22 of the Delaware Code.

Section 3. Amend Section 50, Article IV of the Charter of the City of Dover by making deletions as shown by strike through and insertions as shown by underline as follows:

Section 50. Debt limit.

(h) Any and all provisions of this Section 50 and any other section of this Charter limiting the amounts of indebtedness to be incurred or taxes to be levied or collected by the council shall not apply to any indebtedness incurred or any special ad valorem taxes, special taxes, or ad valorem taxes levied or collected pursuant to or in connection with Chapter 17 or Chapter 18 of Title 22 of the Delaware Code.
