SENATE BILL NO. 152
AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO DRIVER LICENSES.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend § 2703 (a), Title 21 of the Delaware Code by deleting in the first sentence the phrase:
"vehicle having less than 3-foot distance between the adjacent wheels,"
Section 2. Amend § 2703 (a), Title 21 of the Delaware Code by adding in the first sentence after the word "vehicle" and before the word "upon" the phrase:
", as defined in Title 21, § 101 (32),".
Section 3. Amend § 2703 (a), Title 21 of the Delaware Code by deleting the second and third sentences in their entirety and substituting in lieu thereof the following:
"The Department shall place a motorcycle endorsement on the driver license authorizing the operation of such vehicle. A person who passes an examination administered by the Department on a 3-wheeled motor vehicle shall have a restriction placed on his driver license, in addition to the motorcycle endorsement, limiting him to the operation of 3-wheeled motor vehicles."
Section 4. The Department may waive the examination as required under § 2703 (a), Title 21 of the Delaware Code for any person with a 3-wheeled motor vehicle properly registered under Chapter 21, Title 21 of the Delaware Code prior to the effective date of this Act. Any person who satisfies the criteria of this exemption is still required to obtain the proper motorcycle endorsement with a 3-wheeled motorcycle restriction.
Section 5. This Act shall go into effect 180 days after the date of enactment.
