AN ACT TO AMEND TITLE 18 OF THE DELAWARE CODE RELATING TO SUPPLEMENTAL COVERAGE FOR CHILDREN OF INSUREDS.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend § 3354, Title 18 of the Delaware Code by striking the existing language in current subsection (a)(3)a. and substituting in place thereof: “Is less than 26 years of age;”; deleting “c.”, redesignating “d.” and “e.” as “c.” and “d.”, respectively; and striking “twenty-fourth” where it appears in § 3354(b) and inserting “twenty-sixth” in its place.
Section 2. Amend § 3570, Title 18 of the Delaware Code by striking the existing language in current subsection (a)(3)a. and substituting in place thereof: “Is less than 26 years of age;”, deleting “c.”, redesignating “d.” and “e.” as “c.” and “d.” respectively; and striking “twenty-fourth” where it appears in § 3570(b) and inserting “twenty-sixth” in its place.
Section 3. The provisions of this Act shall be of no force or effect if “The Patient Protection and Affordable Care Act”, Public Law 111-148, is declared unconstitutional by the Supreme Court of the United States of America. Section 4. This Act shall not apply to accident-only, dental only, vision care only, specified diseases, long term care, hospital, indemnity, disability income or other fixed indemnity policies.
