AN ACT TO AMEND TITLE 25 OF THE DELAWARE CODE RELATING TO TITLES AND CONVEYANCES.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :
Section 1. Amend Chapter 3, Title 25 of the Delaware Code by enacting as a new “§ 317. Restriction on collecting fees for community amenities by community developers and/or homeowner associations” as follows:
Ҥ317. Restriction on collecting fees for community amenities by community developers and/or homeowner associations.
No community developer or homeowner association shall collect fees for amenities that have not yet been opened for residents’ use in a community development.”.
