AN ACT TO AMEND CHAPTER 24A, TITLE 6 OF THE DELAWARE CODE RELATING TO DEBT MANAGEMENT SERVICES.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :
Section 1. Amend § 2406A of Title 6 of the Delaware Code by deleting existing paragraph (15) and inserting instead the following:
“(15) At the applicant’s expense, the results of a national criminal history record check, including fingerprints, provided pursuant to the Federal Bureau of Investigation appropriation of Title II of Public Law 92-544 (28 U.S.C. § 534) conducted within the immediately preceding 12 months, covering every officer of the applicant and every employee or agent who is authorized to have access to the trust account required by § 2422A of this title.”
Section 2. Amend § 2411A(b)(3) by changing the reference therein from “§ 2406A(8) and (9)” to “§ 2406A(9) and (10)”.
Section 3. Amend both § 2405A(b)(4) and § 2411A(b)(5) by deleting subparagraphs (D) and (E) in each section, and inserting instead the following new subparagraph (D) in each section:
“(D) Naming the Attorney General as an additional interested party to receive notice upon cancellation of the policy.”
Section 4. Amend both § 2405A(b)(4)(C) and § 2411A(b)(5)(C) by inserting the word “and” after the semicolon (;) at the end of these two subparagraphs.
Section 5. Amend § 2422A by deleting paragraphs (j) and (k) in their entirety and re-designating paragraph (l) as paragraph (j).
Section 6. Amend § 2405A(b)(4) by deleting $500,000 and inserting $250,000.
