AN ACT TO AMEND TITLE 14 OF THE DELAWARE CODE RELATING TO CHANGING BOUNDARIES.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend §1026 of Title 14 of the Delaware Code by deleting section (d)(1) and substituting in lieu thereof the following:

“Notwithstanding the provisions of subsections (b) and (c) of this section, the State Board of Education may change or alter the boundaries of any reorganized school district with boundaries located in Kent County if written requests for such changes or alterations are submitted by the respective school district boards of education who will be impacted by the change or alteration. The proposed changes must result in the clarification of district boundaries using tax parcels registered in Kent County as of January 1, 2006 and any real property being transferred must be contiguous to the school district to which the transfer is requested.”

Section 2. Further Amend §1026 of Title 14 of the Delaware Code by deleting section (d)(2) and substituting in lieu thereof the following:

“The school boards of education in the effected districts shall conduct a public hearing on the proposed request prior to taking any formal action. The hearings shall be advertised at least once a week for 2 consecutive weeks in a newspaper published or circulated in Kent County and the districts. Such advertising shall occur at least 20 days prior to the public hearing on the proposed boundary change or alteration.”

Section 3. Further Amend §1026 of Title 14 of the Delaware Code by deleting “1994” at the end of the sentence in section (d)(5) and substituting in lieu thereof the following:

“2008”

Section 4. This Act shall be effective upon its enactment into law.
