AN ACT TO AMEND TITLE 11 AND TITLE 21 OF THE DELAWARE CODE RELATING TO PROBATION BEFORE JUDGMENT AND REQUIRING ALL TRAFFIC CONTROL LAW VIOLATIONS TO BE POSTED ON A COMMERCIAL DRIVER'S LICENSE HOLDER'S DRIVING RECORD.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :

Section 1. Amend §4218(c)(1), Title 11, by adding a new subsection “(h)” to read as follows:

“(h) The person is charged with an offense involving a motor vehicle and holds a Commercial Driver License (CDL).”

Section 2. Amend Chapter 26, Title 21, by adding a new section, §2625 Masking Violations, to read as follows:

Ҥ2625 Masking Violations.

The State shall not mask, defer imposition of judgment, or allow an individual to enter into a diversion program that would prevent a CDL driver’s conviction for any violation, in any type of motor vehicle, of a State or local traffic control law (except a parking violation) from appearing on the driver’s record, whether the driver was convicted for an offense committed in this State or another State.”
