AN ACT TO AMEND TITLE 24 OF THE DELAWARE CODE RELATING TO PROFESSIONS AND OCCUPATIONS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :

Section 1. Amend subsection (13), §5101, Title 24, Delaware Code by striking the words “or manicuring” and substituting in lieu thereof the words “electrology or nail technology”.

Section 2. Amend subsection (b), §5106, Title 24, Delaware Code by striking the words “and manicuring” and substituting in lieu thereof the words “electrology or nail technology”.

Section 3. Amend paragraph (6), subsection (a), §5107, Delaware Code by striking the word “felony” and substituting in lieu thereof the words “crime substantially related to the practice of cosmetology, barbering, electrology or nail technology”.

Section 4. Amend paragraph (4), subsection (a), §5113, Delaware Code by striking the phrase “within the past five years”.

Section 5. Amend paragraph (4), subsection (a), §5113, Delaware Code by striking the words “or manicuring” and substituting in lieu thereof the words “electrology or nail technology”.

Section 6. Amend §5136, Title 24, Delaware Code by adding a new paragraph (5) to read as follows:

“(5) Shall not have a criminal conviction record nor pending criminal charge relating to an offense the circumstances of which substantially relate to actions as a certified aesthetician. Applicants who have criminal conviction records or pending criminal charges shall request appropriate authorities to provide information about the conviction or charge directly to the Board in sufficient specificity to enable the Board to make a determination whether the conviction or charge is substantially related to actions as a certified aesthetician.”.
