SENATE AMENDMENT NO. 1

AN ACT PERMITTING THE COLONIAL SCHOOL DISTRICT TO CONVEY TO THE NEW CASTLE SENIOR CENTER THE BUILDING AT 4TH AND SOUTH STREETS, NEW CASTLE, DELAWARE.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Three-fourths of all members elected to each house thereof concurring therein):

WHEREAS, the Colonial School District holds title to the building and land located at 4th and South Streets, New Castle, Delaware (the “Booker T. Washington Property”); and

WHEREAS, the State of Delaware has a 60% interest in the Booker T. Washington Property and the Colonial School District has a 40% interest in the Booker T. Washington Property; and

WHEREAS, the Colonial School District has no intention of using the Booker T. Washington Property for purposes beneficial to the residents of the City of New Castle; and

WHEREAS, the Colonial School District is willing to convey the Booker T. Washington Property for consideration of $1.00, but the Colonial School District is prohibited from doing so by 14 Del.C. §1057.

NOW THEREFORE:

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (three-fourths of all members elected to each House thereof concurring therein):

Section 1. Section 1057 of Title 14 notwithstanding, the Colonial School District may convey the Booker T. Washington Property to the New Castle Senior Center. This conveyance shall be for consideration of $1.00, shall include the State’s 60% interest in the Property, and shall be “as is” in that the New Castle Senior Center shall accept the building and land in their present condition.
