AN ACT TO AMEND CHAPTER 59, VOLUME 63, LAWS OF DELAWARE AS AMENDED, ENTITLED "AN ACT TO INCORPORATE THE TOWN OF DEWEY BEACH" TO APPROVE AN AMENDMENT OF SECTION 10(b) OF THE CHARTER OF THE TOWN OF DEWEY BEACH, DELAWARE ENTITLED "MANNER OF HOLDING ELECTIONS" TO PROVIDE FOR VOTER ELIGIBILITY IN MUNICIPAL ELECTIONS TO CERTAIN TRUSTEES OF TRUSTS TO WHICH REAL ESTATE LOCATED WITHIN THE TOWN HAS BEEN CONVEYED.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):

Section 1. Amend Chapter 59, Volume 63, Laws of Delaware, Town Charter of Dewey Beach, Section 10(b) by deleting the existing language of Section 10(b) in its entirety and insert in lieu thereof the following:

“(b) Each person eighteen years of age or older, who is a bona fide resident and domiciliary of the Town of Dewey Beach, or who is an owner of real property within the Town, or who holds a lease for five years or more on property within the Town, shall be qualified to vote in the election of Town officials as herein provided. Non-resident persons eighteen years of age or older who are both a settler/creator(s) and trustee(s) of a valid trust to which real property which is located within the Town has been conveyed which conveyance is recorded in the Office of the Recorder of Deeds in and for Sussex county, shall be qualified to vote in the election of Town officials, provided that the Trust document which identifies the trustee(s) and the settler/creator(s) must be presented at the time of registration.”
