AN ACT TO AMEND TITLE 14 OF THE DELAWARE CODE RELATING TO THE ISSUANCE OF STATE PUBLIC HIGH SCHOOL DIPLOMAS FOR STUDENTS WHO GRADUATE DURING THE 2003-2004 SCHOOL YEAR.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :

Section 1. Amend §152(a), Title 14 of the Delaware Code, by striking the number “2004” as it appears therein and by substituting in lieu thereof the number “2005”.

Section 2. For students who graduate from all school districts and affected charter schools during the 2003-2004 school year, the Department of Education shall issue traditional State of Delaware diplomas utilizing the rules and regulations governing the issuance of diplomas for the 2002-2003 school year. In addition, the Department of Education shall award a Distinguished Achievement Diploma to every student who qualifies for such under 14 Del. C. § 152.

Section 3. In the event that the panel of national experts created by Executive Order Number 54 determines that changes to the math cut scores or the diploma index formula are necessary, the Delaware Department of Education shall re-calculate the test scores from the 2004 Spring and Summer Administration of the Delaware Student Testing Program for any student who so requests. In the event that such recalculation results in a student earning a Distinguished Achievement Diploma, the Department shall retroactively award the student a Distinguished Achievement Diploma based on the new calculation.
