SENATE AMENDMENT NO. 1

AN ACT TO AMEND TITLE 10 OF THE DELAWARE CODE RELATING TO COURT COMMISSIONERS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :

Section 1. Amend §511(a), Title 10, Delaware Code by inserting between “Senate.” and “Appointees”, the following:

“Upon second and subsequent appointments and confirmations, a Commissioner of the Superior Court shall hold office for a term of 6 years.”

Section 2. Amend §915(a), Title 10, Delaware Code by inserting between “appointment.” and “An”, the following:

“Upon second and subsequent appointments and confirmations, a Commissioner of the Family Court shall hold office for a term of 6 years.”

Section 3. Amend §1315(a), Title 10, Delaware Code by inserting between “Senate.” and “Appointees”, the following:

“Upon second and subsequent appointments and confirmations, a Commissioner of the Court of Common Pleas shall hold office for a term of 6 years.”

Section 4. Amend §1991(a), Title 10, Delaware Code by inserting at the end thereof the following:

“Upon second and subsequent appointments and confirmations, a commissioner shall hold office for a term of 6 years.”

Section 5. All individuals who are court commissioners as of this Act’s enactment into law shall qualify for the 6 year term provided herein upon their next appointment.
