HOUSE BILL NO. 25

AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO COMMERCIAL DRIVERS' TRAINING SCHOOL LICENSING AND DRIVERS' LICENSING.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :

Section 1. Amend § 8307 of Title 21 of the Delaware Code by placing a period "." after the word "only" and deleting the remaining text of the sentence.

Section 2. Further Amend § 8307 of Title 21 of the Delaware Code by inserting after the first sentence the following:

"Driver education classes conducted by State colleges, universities and high schools and programs approved and contracted by the Department of Education are exempt from the licensing requirements of this Chapter when the courses are taught by certified driver training teachers using curriculum approved by those institutions.”.

Section 3. Amend § 2713(d) of Title 21 of the Delaware Code by adding after "before reinstatement." the following sentence:

"Notwithstanding the preceding, the Division must administer written and road skills tests to applicants who are 18 years of age or older, except as otherwise provided in Subsections (b) and (c) of this Section.".
