AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO DNA ANALYSIS AND DATA BANK.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :
Section 1. Amend §4713 (b), Title 29 of the Delaware Code by designating the current language of that subsection as paragraph “(1)” of that subsection and by inserting a new paragraph “(2)” of that subsection to read as follows:
"(2) Any person convicted after the effective date of this Act of any offense that is defined and classified as a felony under Title 11 of this Code shall have a sample of blood taken by the Department of Correction for DNA (deoxyribonucleic acid) law enforcement identification purposes and inclusion in law enforcement identification databases. Any person convicted after the effective date of this Act of such felony offense and who is not sentenced to a term of confinement shall provide a blood sample as a condition of such sentence at a time and place specified by the sentencing court.".
Section 2. This Act shall become effective upon the specific appropriation of funds for such purposes in the Annual Appropriations Act.
