SENATE BILL NO. 122

AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO THE DEPUTY SECRETARY, DIVISION DIRECTORS, AND ACTING SECRETARY.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :

Section 1. Amend the title of §7902, Title 29, by inserting the words “Deputy Secretary;” between the words “Secretary;” and “division directors”.

Section 2. Amend § 7902(b), Title 29 of the Delaware Code by striking it in its entirety and replacing it with the following:

“(b) In the event the position of Secretary is vacant, the Governor, by appointment, shall have the power to fill the position of Deputy Secretary if vacant. A Deputy Secretary so appointed shall serve at the pleasure of the Governor and upon the position of Secretary being filled such Deputy Secretary may be removed from office by the Secretary with the written approval of the Governor.”

Section 3. Amend § 7902(c), Title 29 of the Delaware Code by striking the phrase “director of any division” wherever it appears and substituting in lieu thereof “Deputy Secretary or the director of any division”.

Section 4. Amend §7903(2), Title 29 of the Delaware Code by inserting the words “Deputy Secretary and the” between the words “of the” and “following division directors”.

Section 5. Amend §7922, Title 29 of the Delaware Code by adding the following:

(11) Director of State Service Centers;

(12) Director of Long Term Care Resident Protection;

(13) Deputy Secretary of the Department of Health and Social Services.
