AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO THE STATE CODE OF CONDUCT AND ELECTED AND APPOINTED SCHOOL BOARD MEMBERS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :

WHEREAS, in our democratic form of government, persons serving as members of local school boards hold positions of great responsibility and public trust in which they, through the boards on which they serve, oversee the public education of our State's children and oversee the management of our State's school districts, including their personnel and financial obligations; and

WHEREAS, the public requires rigorous adherence by these persons to the highest standards of honesty, integrity and impartiality; and

WHEREAS, to ensure proper conduct and to preserve pubic confidence, members of local school boards must have the benefit of specific standards to guide their conduct and of mechanisms to guarantee uniform adherence to those standards; and

WHEREAS, it will help encourage citizens to assume pubic office as school board members if clear standards are set that encourage and define their proper role while making clear the kinds of conduct that they should avoid; and

WHEREAS, the provisions of the Delaware Code pertaining to standards for the conduct of officers and employees of the State do not currently apply to local school board members, and there are no other State provisions that set forth such standards.

NOW, THEREFORE:

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend § 5804(11)(a), Title 29, Delaware Code by striking the period at the end of subparagraph 2, and substituting in lieu thereof “; or” and adding a new subparagraph to read as follows:

“3. Who is an elected or appointed school board member."
