BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend §1230, Chapter 12, Title 14 of the Delaware Code by designating all of said section as new subsection (a), and by adding thereto the following new subsection:
“(b) A school district may employ a retired teacher to be a substitute teacher within that district and such employment shall not decrease or otherwise adversely affect such retired person’s pension or their retirement benefits. It also will not increase their pension. They will be paid regular substitute teacher pay.
Section 2. Amend Title 29, §5502(a) of the Delaware Code by adding thereto the following new subsection.
“(4) A substitute teacher employed by a school district in the State of Delaware.”
