AN ACT AMENDING THE FISCAL YEAR 2000 BOND AND CAPITAL IMPROVEMENTS ACT AND THE FISCAL YEAR 2001 BOND AND CAPITAL IMPROVEMENTS ACT AND RELATING TO PUBLIC EDUCATION SCHOOL CONSTRUCTION.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Three-fourths of all members elected to each house thereof concurring therein):

Section Amend 72 Del. Laws, c. 258, § 7, by deleting the numbers “87,300”, “508,600”, “24,900”, “34,400”, “834,400”, and “656,700” as they appear in that section in their entirety and substituting in lieu thereof the following: “92,900”, “540,700”, “26,500”, “36,600”, “887,200”, and “698,200” respectively and by recalculating all totals and subtotals therein. Further amend 72 Del. Laws, c. 258, § 7 by deleting the phrase “Thirty Million Four Hundred Sixty Five Thousand Six Hundred Dollars ($30,465,600)” in its entirety and substitute in lieu thereof the following: “Thirty Million Six Hundred One Thousand Four Hundred Dollars ($30,601,400).”

Section Amend 72 Del. Laws, c. 489, § 3, by deleting the number “160,800” as it appears in that section in its entirety and substituting in lieu thereof the number “170,900” and by recalculating all totals and subtotals therein. Further amend 72 Del. Laws, c. 489, § 3 by deleting the phrase “Thirty Million Eight Hundred Ninety Seven Thousand Two Hundred Dollars ($30,897,200)” in its entirety and substitute in lieu thereof the following: “Thirty Million Nine Hundred Seven Thousand Three Hundred Dollars ($30,907,300).”

Section Amend 72 Del. Laws, c. 489, § 7, by deleting the numbers “1,207,100”, “101,200”,and “484,900” as they appear in that section in their entirety and substituting in lieu thereof the following: “1,137,700”, “107,600”, and “515,600” respectively and by recalculating all totals and subtotals therein. Further amend 72 Del. Laws, c. 489, § 7 by deleting the phrase “Twenty Five Million, Six Hundred Ninety Three Thousand Four Hundred Dollars ($25,693,400)” in its entirety and substitute in lieu thereof the following: “Twenty Five Million Six Hundred Sixty One Thousand One Hundred Dollars ($25,661,100).”

Section Amend 72 Del. Laws, c. 489, § 95 by deleting the year “2001” as it appears therein and substituting in lieu thereof the year “2000”.

Section Amend 72 Del. Laws, c. 489 by designating existing § 95 as § 95 (a) and by adding a new subsection 95 (b) to read as follows:

“(b) Notwithstanding the provisions of 30 Del. C. § 5423(c)(1), for the fiscal year ending June 30, 2000, the State shall transfer $7,000,000 of realty transfer taxes to the Project Account.”

Section Amend 72 Del. Laws, c. 489 by deleting the phrase “Seaford Riverfront” as it appears in the Section 1 Addendum and substituting in lieu thereof the phrase “Seaford Industrial Park”.

Section 7. The following local school districts may apply for additional authorization to increase their amount of the capital projects (through the Certificate of Need) as a result of construction market pressures to be funded in the Fiscal Year 2002 Bond and Capital Improvements Act. The Department of Education shall review the applications and may approve such applications with the concurrence of the Budget Director, the Controller General and the Co-Chairs of the Joint Legislative Committee on the Capital Improvement Program. Local school districts are required to pay for the local share of each project under this section. The following funds may be used to meet the required local match: Minor Capital Improvement Funds and/or Division III Equalization. The following projects shall be eligible:

Appoquinimink- the new Olive B. Loss ES and the new 720 pupil ES

Cape Henlopen- 2 new MS

Milford- the New Banneker ES

Indian River- the new HS South and the new HS North

New Castle County Vo-Tech- the new high school

Smyrna- the new 700 pupil Middle/Junior HS.
