AN ACT PROPOSING AN AMENDMENT TO ARTICLE IV. SECTION 26 OF THE DELAWARE CONSTITUTION OF 1897. AS AMENDED, RELATING TO THE POWERS AND DUTIES OF THE PROTHONOTARY AND THE ENTRY OF TESTATUM FIERI FACIAS

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (two-thirds of all members elected to each house thereof concurring therein):

Section 1. Amend Article IV. Section 26 of the Delaware Constitution of 1897. As amended. by adding the following sentence at the end of the section:

"This section shall not he interpreted to prevent the transfer of a judgment nom any court of one count) to the Superior Court of another county pursuant to legislation enacted by the General Assembly. nor shall it he construed to require the issuance or entry into the record of a testatum fieri facias when a judgment is transferred from a court of one county to the Superior Court of another county pursuant to legislation enacted 1.1 the General Assembly.
