AN ACT TO AMEND CHAPTER 5, TITLE 11 OF THE DELAWARE CODE RELATING TO SENTENCES FOR ROBBERY IN THE SECOND DEGREE.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend 5831 of Chapter 5, Title 11 of the Delaware Code by designating the present paragraph as (a) and adding new subparagraphs (b) and (c) to read as follows:

"(b) Notwithstanding 34204 of this Title, a person convicted of robbery in the second degree under subparagraph (a) of this section against a person the age of 65 years or over, and who has been previously convicted or adjudged delinquent for having committed a felony or misdemeanor within the last five years where the victim suffered physical injury, shall receive a minimum mandatory sentence of not less than one year. Such sentence shall not be subject to suspension and no person convicted for such a violation shall be eligible for parole, probation or any other reduction, nor shall such an offender be permitted to be furloughed or be allowed to participate in work release or supervised custody outsdie the prison institution or facilities."
