AN ACT TO AMEND CHAPTER 13. TITLE 19 DELAWARE CODE. PERTAINING TO EMPLOYEE RELATIONS.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend §1307, Chapter 13, Title 19 Delaware Code, by striking said Section in its entirety and substituting in lieu thereof the following:
"§1307. Failure to obtain majority of votes
(a) In any election where there are more than two (2) choices on the ballot and none of the choices receives a majority of the votes cast, a run off election shall be conducted. The ballot in the run off election shall contain the two (2) choices on the original ballot that received the largest number of votes.
(b) No election shall be held pursuant to this Chapter within twelve (12) months from the date of a preceding valid election resulting in certification or non certification of an exclusive bargaining unit."
