AS AMENDED BY HOUSE AMENDMENT NOS. 1, 2 AND 3

AN ACT TO AMEND CHAPTER 5, TITLE II, DELAWARE CODE RELATING TO DESECRATION OF A BURIAL PLACE.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each House thereof concurring therein):

Section 1. Amend §1331, Subchapter VU, Chapter 5, Title II, Delaware Code by deleting the words "or burial" after the word "worship" and before the word "the" as they appear therein.

Section 2. Further amend Subchapter VII, Chapter 5, Title 11, Delaware Code by adding a new section which new section shall read as follows:

"§1340. Desecration of burial place.

A person Is guilty of desecration of a burial place if he intentionally defaces, damages, pollutes or otherwise physically mistreats any such burial place. Any person who desecrates a burial place is guilty of a misdemeanor and upon conviction shall be fined not less than $1,000 nor more than $10.000".
