AN ACT TO AMEND CHAPTER 43, TITLE 21, DELAWARE CODE, RELATING TO LAMPS ON PARKED VEHICLES.

Be it enacted by the General Assembly of the State of Delaware:

Section 1. Amend §4344, Chapter 43, Title 21, Delaware Code by striking said section in its entirety and inserting in lieu thereof a new §4344 to read as follows:

"4344. Lamps on parked vehicles.

(a) Every vehicle shall be equipped with one or more lamps which, when lighted, display a white or amber light visible from a distance of 500 feet to the front of the vehicle, and a red light visible from a distance of 500 feet to the rear of the vehicle. The location of the lamp or lamps shall always be such that at least one lamp or combination of lamps meeting the requirements of this section is installed as near as practicable to the side of the vehicle which is closest to passing traffic. The foregoing provisions shall not apply to motorcycles.

(b) Whenever a vehicle is parked or stopped upon a street or highway, whether attended or unattended, when there is insufficient light to reveal any person or object within a distance of 500 feet upon the highway, the vehicle so parked or stopped shall be equipped with and shall display lamps meeting the requirements of subsection (a), but it shall not be necessary to display the lamps upon a vehicle which is lawfully parked upon a portion of a roadway which is ordinarily or customarily used for parking vehicles.
