AN ACT TO AMEND SUBCHAPTER 1, CHAPTER 21, TITLE 21 OF THE DELAWARE CODE RELATING TO THE REQUIREMENT OF INSURANCE ON MOTOR VEHICLES.

Be it enacted by the General Assembly of the State of Delaware (two-thirds of all members elected to each House thereof concurring therein):

Section 1. Amend §2118 (a), Subchapter 1, Chapter 21, Title 21 of the Delaware Code by striking the first paragraph of subsection (a) in its entirety and substituting in lieu thereof a new paragraph to read as follows:

"No owner of a mtor vehicle required to be registered in this State, other than a self-insurer, as defined in this Title, and other than vehicle registered in another State not requiring insurance, shall operate or authorize any other person to operate such vehicle unless the owner has insurance on such motor vehicle providing the following minimum insurance coverage:"

Section 2. Amend §2118, Subchapter 1, Chapter 21,

Title 21 of the Delaware Code by adding thereto the following paragraphs:

"(1) Every insurance company authorized to transact the business of motor vehicle liability insurance in this State shall file with the Insurance Commissioner as a condition of its continued transaction of such business with this State a form approved by the Insurance Commissioner stating that its motor vehicle liability policies, wherever issued, shall be deemed to provide the insurance required by this Section when the vehicle is operated in this State. A non-admitted insurer may file such a form.

(m) A motor vehicle registration shall not be issued or renewed for any vehicle not covered by a vehicle insurance policy meeting the requirements of this Title.

() The Division of Motor Vehicle upon showing of its records or other sufficient evidence that the required insurance has not been provided or maintained for a motor vehicle shall immediately suspend the registration of such vehicle.

(a) Immediately upon notice of suspension of the registration of the vehicle, the owner shall return the registration certificate to the Division of Motor Vehicles. The giving of notice is complete upon the expiration of four days after such deposit of such notice. It shall be unlawful to possess or display a registration certificate for a vehicle for which the registration has been suspended.

(b) The minimum fine for a violation of the provisions of subsection (o) of this section shall be not less than twenty-five dollars ($25.00) nor more than one hundred dolars ($100.00).

(c) Any person whose vehicle's registration has been suspended under subsection (o) of this section shall pay a fee of fifteen dollars ($15.00) at the end of such suspension for the return of his registration certificate.

() The Director of the Division of Motor Vehicles may adopt such rules and regulations, not inconsistent with this Title, as are necessary to enforce the provisions of this section."
