AN ACT TO AMEND SUBCHAPTER II, CHAPTER 47, TITLE 9, DELAWARE CODE RELATING TO GARBAGE COLLECTION IN UNINCORPORATED AREAS OF KENT COUNTY.
Be it enacted by the General Assembly of the State of Delaware..
Section 1. §4728, Title 9, Delaware Code, is hereby repealed.
Section 2. Amend §4729, Title 9, Delaware Code by striking said section in its entirety and substituting in lieu thereof a new section tb read as follows:
"§4729. Continuation and termination of contracts
Once a garbage collection district has been formed and garbage collection undertaken pursuant to this subchapter, the county government may, without further public hearings, enter into new contracts for garbage collection. However, the county government may determine not to continue garbage collection for any garbage collection district at the expiration of any contract entered into pursuant to this subchapter. The county government may without further public hearings, consolidate 2 or more garbage collection districts into a single district."
Section 3. Amend §4725, Title 9, Delaware Code, by adding thereto at the end thereof the following:
"The county government may provide for contracts in excess of one year and may impose such provisions, conditions and limitations as deemed desirable including requirements that no one bidder may serve the entire county."
