AN ACT MAKING A SUPPLEMENTARY APPROPRIATION TO THE DEPARTMENT OF HEALTH AND SOCIAL SERVICES TO BE USED FOR PAYMENT OF CERTAIN OBLIGATIONS OF THE BLACKMAN'S DEVELOPMENT CENTER, INC.

Be it enacted by the General Assembly of the State of Delaware. (three-fourths of all of the members elected to each House thereof concurring therein):

Section 1. The sum of twenty-five thousand dollars ($25,000) is hereby appropriated to the Department of Health and Social Services to be used for the payment of certain lawful obligations of the Blackman's Development Center, Inc. as directed in Section 2 of this Act.

Section 2. The Department shall use ten-thousand dollars ($10,000) of the sum appropriated herein to pay any and all delinquent past due payments of principal and interest owed by the Blackman's Development Center, Inc. to James L. Scott and Mae L. Scott under a certain bond and mortgage executed on May 29, 1973: said mortgage being recorded in the Office of the Recorder of Deeds in and for New Castle County in Mortgage Record W, Volume 70, Page 502, and all costs incidental to foreclosure proceedings instituted in the Superior Court on the aforementioned mortgage by the said James L. and Mae L. Scott and necessary to terminate said foreclosure proceedings. Any portion of said ten-thousand dollars ($10,000) remaining after payment of said delinquent mortgage payments and costs shall be applied to the unpaid principal balance of said mortgage obligation. The Department shall pay fifteen-thousand dollars ($15,000) of the sum appropriated herein to the other creditors of the

Blackman's Development Center, Inc., having valid legal claims against the said Blackman's Development Center, Inc. as of the effective date of this Act. Such other creditors shall be paid by the Department on a pro rata basis. The Department shall have exclusive and sole authority to determine the validity of such claims for the purpose of carrying out its duties under this Act.

Section 3. This Act is a supplementary appropriation Act and the sums hereby appropriated shall be paid out of the General Fund of the State of Delaware from funds not otherwise appropriated.

Section 4. Any money appropriated herein and unexpended shall revert to the General Fund of the State of Delaware on June 30, 1976.
